ORDER

This writ petition is filed seeking to declare the suspension proceedings dated 6.9.2016 issued by the 2nd respondent, as arbitrary and illegal.

The petitioner joined as Sub Inspector of Police and he was posted at Karimnagar. While so, on 1.10.2015, a written complaint was received from one Kusa Anjali w/o Kusa Ravi and he entered the same in GD for enquiry and counseling. However, the parties settled the matter amicably on 2.10.2015 and reported compromise to the police and hence, the case was closed on 2.10.2015. Thereafter, husband of the said Anjali approached the Human Rights Commission and filed HRC No.6309 of 2015 alleging that the petitioner summoned him to Police Station, Boinpally, Karimnagar District and beat him indiscriminately. On the said complaint, without issuing notice to the petitioner, an ex parte order was passed directing the Telangana Government to pay compensation of Rs.10,000/- to the victim. On receipt of the said order, the 3rd respondent issued proceedings on 29.8.2016 placing the petitioner under suspension and the same was forwarded to the 2nd respondent, who in turn, passed an order on 6.9.2016. Challenging the said orders dated 6.9.2016 and 29.8.2016, the present writ petition is filed.

A reading of the impugned order shows that Andhra Pradesh Human Rights Commission, Hyderabad, took a serious view of the highhanded behaviour of the petitioner towards the victim and awarded compensation of Rs.10,000/- to him. Since the act of the petitioner brought disrepute and tarnished the image of the police, he was placed under suspension.

The matter has to be enquired by the competent authority and at this stage, this Court is not inclined to interfere with the order of suspension passed against the petitioner. However, the 2nd respondent is directed to complete enquiry against the petitioner after affording an opportunity of hearing to him within a period of three months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 30th September, 2016 rkk
