THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4985 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.335 of 2022 on the file of Station House Officer, Kukatpally Police Station, Cyberabad registered for the offence punishable under Section 304-B of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused No.1 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the de facto complainant lodged the present complaint against this petitioner who is Accused No.1, parents in law/Accused Nos.2 and 3 and brother-in-law/Accused No.4, stating that the marriage of his deceased daughter namely Nikitha was performed with this petitioner on 06.06.2021 and gave dowry of Rs.10,00,000/- cash and 35 tulas of gold. Further, this petitioner and others also demanded Ac.04-25 guntas of farm land

should also be given. However, the de facto complainant gave an amount of Rs.10,00,000/- as additional dowry to this petitioner and others but the harassment, by this petitioner and others did not stopp, vexed with the harassment the deceased went to her house and committed suicide on 27.04.2022 after an alleged quarrel between this petitioner and the deceased.

Learned counsel for the petitioner submits that the petitioner is in jail since 29.04.2022 and the other Accused Nos.2 to 4 were granted the relief of Anticipatory Bail by this Court on 12.05.2022. Learned counsel for the petitioner further submits that, as per the remand report all the witnesses have been examined and except filing of charge sheet the entire investigation is completed. 5.

It is not disputed that according to the remand report 12 witnesses are also examined and it is a case of dowry harassment inflicted by this petitioner and others, for which reason the deceased committed suicide. However, since the petitioner is in jail since 29.04.2022, the petitioner can be released on bail subject to conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted bail subject to the following conditions:

i) The petitioner/Accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of PJCJ-cum-VIII Additional Metropolitan Magistrate, Cyberabad at Kukatpally. ii) The petitioner/Accused No.1 shall appear before the Station House Officer, Kukatpally Police Station on every Monday between 10.30 AM and 01.00 PM for a period of three (03) months or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 22.06.2022 ns
