THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37060 of 2015 ORDER:

This writ petition was filed with the following prayer: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ order or direction particularly in the nature of Writ of Mandamus declaring the action of the respondent No.3 in not registering crime against the unofficial respondents 4, 5 and 6 as illegal, arbitrary and against the principles of natural justice apart from being violative of Article 21 of the Constitution of India and to pass such other or further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." Perusal of the petitioner's complaint reflects that she is seeking police protection from her mother and her mother's family. The only allegation of a possible offence is that her mother threatened to file a kidnap case against her father and his family members.

The petitioner is a minor and it appears that there is a custody battle between the parents in relation to her person. This Court therefore finds no reason to entertain this writ petition at the instance of the minor daughter seeking to support one parent against the other.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 16th November, 2015 IBL
