THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18950 OF 2019 O R D E R:
This Writ Petition is filed seeking a mandamus to declare the action of the respondents in not taking steps for the conduct of skill test to the petitioners in terms of G.O.Ms.No. 74, Animal Husbandry, Dairy Development and Fisheries-II Department dated 21.10.2011, as illegal and arbitrary.
Heard learned counsel for the petitioner.
Learned Government Pleader for Animal Husbandry & Fisheries has placed on record the written instructions received from the District Fisheries Officer, Kamareddy vide letter dated 06.09.2019, which are as under:
" It is submitted that the subject and reference cited above, I am herewith submitting that the Fisherman Cooperative Society, Kishtapoor (V), Pitlam (M), Kamareddy (Dist.) registered with a No. L-333 on 18.04.2006 by the Fisheries Department, Telangana State. Further, it is submitted that the Fishermen Cooperative Society, Kishtapoor is a Fisheries Department Society. The society members paid lease amount to Fisheries Department for two tanks according to G.O.No. 776 and they take lease of tanks for seed stocking, culture and capture fisheries wealth. The Society is having two villages one is Kishtapoor and the other is Siddapoor in its area of operation with a membership of 18 fisherman of Mudiraj Community people, there are four water bodies ( two tanks are department tanks and two are GP tanks) and the total water spread area is Acs.
139.15 guntas. In this connection, the FCS -Kishtapoor having total water spread area Acs.139.15 based on G.O.No. 06 can give one membership on two acres of water body for non-perennial water bodies. Hence, can give new enrolment for 21 new members. As per G.O.Ms.No. 74, if resolution and J-farms submitted by the parent society to the office of the District Fisheries Officer, Kamareddy can give new membership by conducting skill test."
In the light of the written instructions, as there is a scope for enrolment of new members, the respondent authorities shall take necessary steps in accordance with the procedure prescribed for enrolling new members to the extent it is permissible. This exercise be completed within eight weeks from the date of receipt of a copy of this order.
The Writ Petition is disposed of with this order. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
