This writ petition is filed to declare the action of the Tahsildar, Devanaakonda Mandal, Kurnool District (3rd respondent) in not completing the survey of the lands in Sy.No.42/3, 53/B, Devanakonda Village and Mandal, Kurnool District on the applications dated 27.09.2016 and 21.04.2017 submitted by the petitioner as illegal and arbitrary and consequently, direct the 3rd respondent to consider the application of the petitioner and complete the survey forthwith. 3.
There appears to be a dispute between the petitioner and Gram Panchayat on the extent of land. According to the petitioner he is the owner of land to an extent of Ac.5-49 cents in Sy.No.42, Devanakonda Village, which was later sub-divided into three parts. Adjacent land is owned by the Gram panchayat and the Gram Panchayat intends to lay a drainage channel. In the process of undertaking drainage channel, the Gram Panchayat is trying to encroach into the land of the petitioner in Sy.No.42/3. In order to resolve the dispute, petitioner submitted a representation, to survey and demarcate their respective boundaries. 4.
The material on record would disclose that even the Surpanch of Gram Panchayat requested for conducting of survey. 5.
Having regard to the request made by the Surpanch and in order to protect the public property, the 3rd respondent is directed to initiate the process of conducting survey; demarcate the
- 3 - boundaries of Gram Panchayat land and after demarcation and fixation of boundaries is made, direct the Gram Panchayat to appropriately fence the land from future encroachments. The entire exercise shall be completed within a period of two (2) months from the date of receipt of copy of this order. 6.
With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
