Heard Mr.G.Rama Rao petitioners and the learned Assistant Government Pleader (Revenue) for respondents. The petitioners pray for the following relief: "....this Hon'ble Court may be pleased to issue a writ or order or direction, more preferably in the nature of WRIT OF MANDAMUS declaring the notices No.B/1700/2016 and No.B/1709/2016 dated 30.06.2016 and the proceedings dated 01.09.2017 issued by the 4th respondent as illegal, arbitrary, contrary to the evidence on record, and violative of fundamental rights guaranteed under the constitution of India and set aside the same and consequently direct the respondents not to interfere/disposes / disturb the ownership of the petitioners in respect of the land Ac.2-29 guntas situated at Kappapahad Village, Ibrahimpatnam Mandal R.R. district and pass ...."
It is stated that the petitioners submitted an application to the 4th respondent/ Tahsildar for mutation of their names in the revenue records. The 4th respondent, without verifying the records and conducting proper enquiry, issued the notices impugned in the writ petition stating that assigned land cannot be mutated and tried to dispossess the petitioners from their property. It is further stated that the petitioners filed appeals before the 3rd respondent/ Revenue Divisional Officer and the same are pending.
The Assistant Government Pleader, on instructions, submits that the appeals filed by the petitioners before the 3rd respondent would be disposed of as expeditiously as possible. The statement is placed on record.
In the circumstances, I am satisfied the writ petition can be disposed of by this order:
(a) the 3rd respondent/ Revenue Divisional Officer is directed to dispose of the appeals filed by the petitioners as expeditiously as possible, preferably within four months from the date of receipt of a copy of this order; and (b) the respondents are directed not to dispossess the petitioners during the pendency of the appeals. The writ petition is, accordingly, disposed of. There shall be no order as to costs.
