ORDER:

Pending the appeal before respondent No.1 against the order, dated 07.02.2009, of respondent No.2 appointing respondent No.4 as the fair price shop dealer, the petitioner, who is unsuccessful in the selection process, filed this writ petition seeking to set aside the appointment of respondent No.4.

A perusal of the proceeding sheet shows that no interim order has been passed. In the absence of any interim order, it is reasonable to presume that respondent No.4 has been functioning as the fair price shop dealer. Therefore, adjudication of this writ petition on merits is unnecessary. Respondent No.1 is, however, directed to dispose of the appeal filed by the petitioner, if the same has not been done so far, within a period of two months from the date of receipt of a copy of this order, after notice to the petitioner as well as respondent No.4. If the appeal has already been disposed of, no further action needs to be taken by respondent No.1.

Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the Writ Petition, W.P.M.P.No.4674 of 2009 filed by the petitioner for interim relief shall stand disposed of as infructuous.
