THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18923 of 2019 ORDER:

In this Writ Petition, petitioner's grievance is that respondents are interfering with his peaceful possession and enjoyment over the land admeasuring Acs.2.01 guntas in Survey No.395/2 situated at Kannala Village, Palakurthy Mandal, Peddapally District.

It is well settled that no person shall be deprived of his property without following due process of law as right to property is guaranteed under Article 300-A of the Constitution of India.

In those circumstances, the Writ Petition is disposed of with the direction to the respondents not to interfere in any manner with the subject land of the petitioner without initiating proceedings or payment of compensation under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
