HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9871 of 2016 ORDER:

This petition is filed by the petitioners/A.1 and A.2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.142 of 2016 of Rajanagaram Police Station, Rajamahendravaram, registered for the offence punishable under Section 8 (c) read with 20 (b) (ii) (c) of the NDPS Act, 1985.

2. Heard and perused the material available on record.

3. The allegation against the petitioners is that they were found in possession of 67 kgs of Ganja.

4. Learned counsel for the petitioners submitted that the petitioners were arrested on 30.05.2016 and that they are innocent of the offence alleged against them.

5. Learned Public Prosecutor submitted that on 29.05.2016 on credible information about illegal transportation of Ganja, the Inspector of police along with mediators were proceeded to Gait College, Chakradwarabandam Village and found TATA Indica Car bearing No.AP-31-AE-3669 and on seeing police, they tried to escape, but the police searched the van and found 67 kgs., of Ganja.

6. Considering the above facts and circumstances of the case and the submissions of the learned Public Prosecutor, this Court is not inclined to grant bail to the petitioner at this stage.
