THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.14862 of 2011 ORDER:

The issue raised in this writ petition is squarely covered by the decision of this Court in Writ Petition No.3718 of 2013. A copy of the order dated 07.02.2013 passed in the said Writ Petition is placed on record.

In terms thereof and for reasons alike as were mentioned therein, this writ petition is disposed of directing that in case the seigniorage fee on the sand utilized by the petitioner in the works executed by it was deducted from its bills and proof thereof is produced before the Assistant Director of Mines and Geology concerned, no penalty shall be levied.
