ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A4 seeking to quash the proceedings in C.C.No.350 of 2015 on the file of III Additional Chief Metropolitan Magistrate, Vijayawada, for the offences punishable under Sections 468 and 420 IPC, against them.

2. It is alleged in the charge sheet that in the year 2009, while the daughter of the de facto complainant was studying Senior Inter, A1, who is senior to her, induced her on the pretext of love, forced her to get gold chain and ATM card of her father and with that ATM card, A1 had withdrawn a sum of Rs.25,000/-from the account of the de facto complainant. On the complaint, a case in Cr.No.425 of 2009 was registered and the missing girl was handed over to her parents. Later, on 10.05.2011, when the daughter of the de facto complainant went to the College, she did not return home and after two days, his daughter made a phone call that she married A1 and is residing with her husband and in-laws and on 26.06.2011, his daughter also informed that she took the locker key and handed over the same to her mother-in-law as directed by her husband and they withdrawn gold and silver articles by forging the signatures. Based on the complaint, another case in Cr.No.243 of 2011 u/s.379, 420, 468 r/w.34 IPC was registered against the petitioners/A1 to A4.

3. Heard and perused the material on record.

4. As per the charge sheet, there are certain allegations against the petitioners. In view of the same, the matter has to be

decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the presence of the petitioners 2 to 4/A2 to A4 except petitioner No.1/A1 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
