Heard learned counsel for the petitioners and Sri Zakir Ali Danish, learned Standing counsel for respondents. 2.
Petitioners participated in Junior Linemen selections conducted by the Northern Power Distribution Company Limited. The limited grievance of the petitioners in this writ petition is that they were not called for pole climbing test.

According to learned counsel for the petitioners, the 1st petitioner belongs to Scheduled Tribe category. He secured 24 marks and a person who secured 23 marks was called for pole climbing test and not calling the 1st petitioner for pole climbing test is illegal.

With reference to 2nd petitioner, learned counsel submits that 2nd petitioner also secured 24 marks and he belongs to BC-D category and he is not called for pole climbing test on the ground that he did not submit Non Creamy Layer Certificate. 5.
According to learned Standing counsel, on instructions, the last selected candidate in both the categories secured 34 marks i.e., far above the marks secured by the petitioners and that is the only reason why petitioners were not called for pole climbing test. In lieu thereof, the claim of the petitioners is not valid. 6.
Having regard to the above statement of learned Standing Counsel, which is taken on record, the Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed. ___________________ P.NAVEEN RAO, J 24th September, 2019 Rds
