HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 1382 OF 2015 ORDER:

After hearing both sides at the admission stage, the following order is passed.

Having regard to the prima facie accusation contained in the FIR for the charges under Section 506 IPC and under Section 3 (i) (x) of SC & ST (POA) Act, 1989, it is not a fit case to quash the proceedings. Therefore, investigation shall continue to its logical end. However, considering the facts that upon the same incident, petitioners/accused also gave a report to police against the second respondent/complainant and some others, which was registered as Crime No. 6 of 2015 on the file of Pothkapalli Police Station and investigation is in progress in that matter and also considering that the present petitioners have filed a Civil Suit in O.S.No. 195 of 2013 on the file of Court of Senior Civil Judge at Peddapalli against the wife of present complainant and some others and obtained interim injunction in I.A.No. 1808 of 2013, the Police of Pothkapalli Police Station are directed not to arrest the petitioners/A1 & A2 during the course of investigation. The petitioners are directed to cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
