SMT. JUSTICE T. RAJANI CRIMINAL PETITION Nos.1568 and 1291 of 2017 COMMON ORDER:

These petitions are filed for quash of orders in Crl.MP.No.2448 and 2447 of 2016 respectively in C.C.No.6 of 2002 dated 01.11.2016, by virtue of which, the learned I - Additional Metropolitan Sessions Judge, Hyderabad, dismissed the petitions, filed seeking permission to leave the country, and to return the original passport in order to go to pilgrimage.

Heard learned counsel for the petitioner and learned Public Prosecutor. Both of them agree for disposal of these petitions at the admission stage.

The petitioner's counsel brings to the notice of this Court the earlier instance where the petitioner was permitted to leave the country. In Crl.P.No.10561 of 2009, this Court extended the time that is granted by the Court below for leaving the country. After return from the said pilgrimage, passport was deposited. This shows that the petitioner would not jump the bail.

TR, J Crl.P.Nos.No.1568 & 1291 of 2017 Hence, both these Criminal Petitions are allowed and the Court below is directed to return the passport to the petitioner on the condition that he shall execute a self-bond for Rs.50,000/- with two sureties for equal sum, and the petitioner is permitted to leave the country for a period of 8 months from January, 2018 to September, 2018. After return, the petitioner shall deposit his passport before the Court below.
