HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22267 OF 2016 ORDER:

The case of the petitioner is that the 3rd respondent has seized the bore well belonging to the petitioner situated in the land admeasuring Ac.0.161/2 guntas in Sy.No.338 and Ac.0.03 guntas in Sy.No.339/A2 together admeasuring Ac.0.19 guntas situated at Turkapally Village, Valigonda Mandal, Nalgonda District without issuing any notice and against the provisions of Andhra Pradesh Water, Land and Trees Act, 2002. He made a representation on 10.06.2016 to the 3rd respondent requesting him to restore his bore well. As no action has been initiated, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the respondent authorities are directed to restore the bore well of the petitioner by considering the representation of the petitioner dated 10.06.2016. However, this will not preclude the competent authority from taking appropriate action in accordance with law. With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
