THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5156 of 2013 ORDER:
When the Government of India formulated a scheme in the name and style of "SARVA SIKSHA ABIYAN", certain new school buildings were sought to be constructed and also additional class rooms in the existing buildings by providing sanitation facilities along with drinking water in school buildings. The "RAJIV VIDYA MISSION" was created for the said purpose of construction of school buildings and providing drinking water. Nearly 16,000 schools were identified for the said purpose. Pursuant to paper publication issued in the year 2009, the petitioners, who are qualified I.T.I. Diploma holders, applied for the post of Site Engineers. After working for sometime, when they were intimated that their services were terminated with effect from 30.11.2012, the present writ petition was filed.
A counter affidavit was filed on behalf of the respondents stating that the project itself came to an end on 30.11.2012, but pursuant to the interim order passed by this Court in the present writ petition, four of the petitioners were engaged as Site Engineers. This Court passed an order on 13.03.2013 directing the respondents to utilise the services of any Civil Supervisors/Site Engineers, who gained experience pursuant to their earlier appointment, and four Site Engineers were accordingly engaged.
In view of completion of the project on 30.11.2012 and in view of the engagement of four Supervisors on the exigency of service, this Writ Petition is disposed of with a direction to the respondents to consider the case of petitioners, if there is any need for their services in future. No order as to costs.
It is needless to observe that as and when the respondents issue any notification, the petitioners are at liberty to apply, pursuant to the said notification. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
