HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.656 of 2017 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in C.C.No.230 of 2016 on the file of the Judicial Magistrate of First Class, Bellampally, Mancherial District.

Heard and perused the material available on record. The petitioners are alleged to have committed the offences punishable under Sections 403, 409, 420 and 120(B) IPC. Considering the circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C. However, the petitioners are at liberty to move an application before the trial Court under Section 205 Cr.P.C. On such application being filed, the trial Court is directed to dispose of the same, in accordance with law. Till disposal of the said discharge application, the presence of the petitioners before the trial Court is dispensed with.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
