HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 20944 of 2016 ORDER:
Heard learned counsel for the petitioner and Sri N.Venkateswarlu, learned Standing Counsel for the respondentmunicipality. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not preventing the pollution/sewerage with the tank of the petitioner and other joint owners situated in T.S.No.895/1, near Sambhuni Cheruvu under the Palakol Municipality, West Godavari District, as illegal and arbitrary; and consequently to direct the respondents to consider the representations dated 09.03.2015, 20.04.2015 and 10.06.2016.
Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent to dispose of the latest representation dated 10.06.2016 at the earliest.
Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the respondent to dispose of the representation dated 10.06.2016 made by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of ten (10) days from the date of receipt of a copy of the order, if the same is made and still pending consideration. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
