HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 30543 OF 2017 ORDER :

It is the case of the petitioner that though Charge Memo issued vide G.O.Rt.No.114 dated 21.09.2007 pertaining to some irregularities in the year 1996-2003, the disciplinary proceedings have not been concluded till date. Though his name was included in the DPC for promotion as Superintendent, he is not considered for the promotion as disciplinary proceedings are pending against him. Aggrieved by action of the respondents in not concluding the disciplinary proceedings against petitioner, present writ petition is filed.

Heard learned counsel for the petitioner and learned Government Pleader for Services-1.

In view of facts and circumstances, the respondent authorities are directed to conclude the disciplinary proceedings within a period of three (3) months from the date of receipt of a copy of this order, in accordance with law. In default, consider the case of petitioner for promotion, in accordance with law, without reference to disciplinary Charge Memo vide G.O.Rt.No.114, dated 21.09.2017.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________ A.RAJASHEKER REDDY, J 18-09-2017 kvs
