THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18939 OF 2019 O R D E R:

The grievance of the petitioner is that the respondents are not passing orders on his Application dated 13.08.2019 for release of the vehicle bearing Registration No. TS 16 UB 9175 pending disposal of the proceedings under Section 6(A) of the Essential Commodities Act.

Heard learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies.

Considering the submission that the seized vehicle is lying in the premises of the respondent authorities for over two months and exposed to vagaries of nature, and continuing to keep the vehicle in such a state for longer period would ultimately render it unfit for use, the respondent authorities are directed to release the vehicle Mahindra Bolero Goods Carrier bearing Registration No. TS 16 UB 9175 subject to the petitioner furnishing an immovable property security for a sum of Rs.50,000/- (Rupees fifty thousand only) in favour of the 2nd respondent. However, the other proceedings may go on. The petitioner shall not alienate or create any third party security over the vehicle and he shall produce the same as and when required by the respondent authorities. It is made clear, release of the vehicle is subject to the final orders that may be passed in the proceedings under Section 6-A of the Act. The Writ Petition is disposed of accordingly. No costs.
