This writ petition is filed challenging the action of the respondents 5 and 6 in locking the petitioner's houses bearing H.Nos.4-32-1427/10 & 2-1-738/1, Venkatapapaiah Nagar, Allwing Colony, Kukatpally Mandal and Circle under GHMC Medchal-Malkajgiri District, R.R.District, without following the due process of law.

Learned Assistant Government Pleader for Home produced written instructions dt.30.08.2019 submitted by the Sub-Inspector of Police, Jagadgirigutta P.S., Cyberabad Commissionerate. To the extent of their relevance to the present writ petition, the said instructions read as under.

"It is submitted that basing on the complaint of one K.Padma Reddy, a case is registered against V.Venkat Reddy in Crime No.528/2019, U/s.406, 420, 468, 471, 379 IPC of Jagathgirigutta police station on 09.08.2019, wherein he stated that the said Venkat Reddy committed theft of her property documents of H.Nos.4-32-1427/10 and 2-1-738/1 by cheating and forged her signatures and sold out the property to others (i.e. the petitioner in the present writ petition namely Ramesh) It is submitted that during the course of investigation LW-1 was examined and her statement was recorded and on knowing about the registration of crime the accused is absconding and the K.Padma Reddy has locked the house.

It is submitted that the allegations made by the petitioner that the 5th and 5th respondents taken keys from her is false and denied herewith, as the respondent No.4 & 5 never locked the houses in the above cases nor taken any keys regarding the houses and the

respondent No.4 & 5 are not concerned with the locking of the houses or with the keys.

It is respectfully submitted that the respondent police never interfered in the civil disputes of the petitioner at any point of time."

Learned counsel for the petitioner submits that respondents 4 and 5 have locked the premises.

But, the respondents have denied that they have locked premises. These disputed questions of fact cannot be gone into the writ petition. In view of the same, the writ petition is disposed of granting liberty to the petitioner avail alternate remedy as may be available to him under law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
