THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5257 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure, 1973 by the petitioners/A-3 to A-5, A-7, A-10, A11, A-13 to A-15 and A-17 to A-19 seeking to direct the XXV Metropolitan Magistrate, Kukatpally at Miyapur to recall the N.B.Ws issued against them on 10.3.2016 in C.C.No.558 of 2016 pending on the file of the said Court.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioners are punishable under Sections 448, 427, 323 and 506 read with 34 I.P.C.

4. Learned counsel for the petitioners submitted before this Court that N.B.Ws are pending against the petitioners and the same may be recalled; that the petitioners are ready to face the trial and they will not flee from the hands of justice.

5. Having heard the learned counsel for the petitioners and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that this Criminal Petition can be disposed of with the following directions:

The petitioners/ A-3 to A-5, A-7, A-10, A-11, A-13 to A-15 and A17 to A-19 are directed to approach the trial Court and file a petition to recall the warrants issued against them and on such petition being filed, the learned Magistrate is directed to recall the warrants on the same day on their execution of a bond for a sum of Rs.1,000/- (Rupees one thousand only) each with one surety for a like sum each and further, the petitioners are directed to appear before the trial Court

regularly.
