HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5314 OF 2018 ORDER:

The petitioner is A.2 in crime No.224 of 2017 of Manuguru Police Station, Kothagudem District, registered for the offence punishable under Section 420 IPC. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the FIR and the bail application averments and the dismissal order of the anticipatory bail moved before the learned V Additional Sessions Judge, Kothagudem, in Crl.M.P.No.226 of 2018 dated 14.03.2018.

A perusal of the FIR shows the role of the petitioner to part with huge amount under the guise and pretence of providing public employment. Thereby, the petitioner does not deserve any concession of anticipatory bail. However, it will not prejudice any of his right to move for regular bail by surrender before the concerned Court on own merits uninfluenced by the observations herein.

Hence, this Criminal Petition is dismissed.
