THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.9332 OF 2004 ORDER:

This writ petition is filed seeking to declare the action of the respondents in attaching the movable property i.e., A/c Generator on 7-5-2004 without giving notice to the petitioner, as illegal, arbitrary, unjust, contrary to law and violative of principals of natural justice.

It is the case of the petitioner that the respondents have issued order of attachment of a movable property without issuing notice to him.

Having regard to the facts and circumstances of the case and since the respondents have issued order of attachment of a movable property of the petitioner without issuing any notice, the writ petition is allowed, setting aside the impugned order dated 7-05-2004 issued by the third respondent. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
