ORDER

The petitioner is arrayed as sole accused in Crime No.71/2026 on the file of Mallapur Police Station, Jagitial District, for the alleged offence under Section 103(1) of the BNS, 2023.

Heard Sri Madas Bharath Chandra, learned counsel for petitioner, and Sri D. ARun Kumar, learned Additional Public Prosecutor, appearing for respondent - State. 3.

The brief facts of the case are that on 11.04.2026 the defacto-complainant lodged a complaint with the police stating that the petitioner/accused indiscriminately beat his mother on her face and forehead with his hands and pushed her down with an intention to kill her, due to which her mother sustained bleeding injuries and succumbed to the said injuries. 4.

Learned counsel for the petitioner would contend that the entire investigation has been completed and a false case was filed against the petitioner/accused and the witnesses have already been examined and that the petitioner was arrested and remanded to judicial custody on 12.04.2026, and has been languishing in the judicial custody since then. Therefore, prayed this Court to allow this Criminal Petition.

Per contra, learned Additional Public Prosecutor would contend that serious allegations are made out against the petitioner/accused, that he has caused the death of his own mother by indiscriminately beating her on her nose and

forehead, so as to kill her. Therefore, prayed this Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, considering the age of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of District Session Judge, at Jagtial.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
