THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18701 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to direct the 1st respondent to remove all the illegal drainages constructed by the respondent Nos.3 to 6 and also to remove the illegal constructions made by the 3rd respondent over the drainage line and consequently, direct the 1st respondent to take action on the representation made by the petitioners, dated 25.04.2017.

Heard and perused the material available on record. The case of the petitioner is that the respondents 3 to 6 are residing in the southern side of his house and they blocked the existing drainage situated in front of their house and intentionally excavated sluices across the road passage and opened it on the side of the petitioner's house and dumping their drain wastage and overflow of the drain water into the basement of the petitioners' compound wall and the 3rd respondent constructed his house illegally by encroaching the road which is obstructing drainage of respondents 4 to 6. The petitioner made representation, dated 25.04.2017, but no action has been taken so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

The 1st respondent is directed to consider the representation made by the petitioner, dated 25.04.2017, and take appropriate action in accordance with law.

With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
