THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18955 of 2019 O R D E R:
Petitioner asserts that he is in occupation of house bearing Nos.4-239 and 240 in Survey Nos.479 and 480 situated at Old Check Post, Pedda Amberpet Village, Abdullapurmet Mandal, Nalgonda District and that on earlier occasion, when the respondents sought to demolish the above said house, he filed W.P.No.7695 of 2019, wherein this Court directed the respondents not to interfere with the possession of the petitioner without following due process of law. His grievance is that though he submitted a representation on 16.07.2019 to respondent No.5-District Collector, Ranga Reddy seeking regularization of his occupation, no action has been taken thereon. Hence, he filed this writ petition.
Learned Government Pleader for Revenue submits that the cut off date for consideration of the applications for regularization and transfer of rights in terms of G.O.Ms.No.59, dated 30.12.2014 is 28.02.2015 and there is no further extension granted, as such, the Scheme being not available, question of consideration of the representation of the petitioner does not arise.
the petitioner that he is in occupation of the property in question is false and baseless.
In view of the above, there cannot be any mandamus issued to the respondents at this point of time to consider the representation of the petitioner. As it is represented that the petitioner being a retired employee of the Government, the authorities of the Roads and Buildings Department shall take necessary steps to prevent the unauthorized and illegal occupation of the petitioner over the Government property. In those circumstances, the writ petition lacks merit and is dismissed.
