HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.786 of 2014 ORDER:

This petition is filed to withdraw O.P.No.561 of 2014 from the file of District and Sessions Judge, Rajahmundry, East Godavari District and transfer the same to Family Court, Ranga Reddy District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of the petition, according to which, her marriage with respondent took place at Venkateshwara Kalyana Mandapam, Vansthalipuram on 10.04.2010 and due to disputes she is staying at her parents house and that she lodged a complaint also with Saroornagar Police Station, which is registered as Crime No.93 of 2013 pending on the file of XIV Metropolitan Magistrate at L.B.Nagar, Cyberabad and respondent is attending in the said case. She contended that respondent filed O.P at Rajahmundry and it is far away from Ranga Reddy and it is difficult for her to travel from Ranga Reddy to Rajahmundry to defend O.P No.561 of 2014. She contended that respondent is residing at Hyderabad and only to harass her O.P is filed at Rajahmundry. She further contended that she got small child and she has no source of income to meet travel expenses, and for these reasons, she prayed for transfer of O.P.No.561 of 2014 from District & Sessions Judge, Rajahmundry to Family Court, Ranga Reddy.

3. Other side filed counter disputing the affidavit averments of petitioner/wife.

5. I have perused affidavit of petitioner and counter averments of respondent herein. On a scrutiny of the same, I am of the view that

request of wife has to be considered.

6. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.561 of 2014 is withdrawn from the file of District and Sessions Judge, Rajahmundry, East Godavari District and transferred to Family Court, Ranga Reddy for disposal in accordance with law.

7. Accordingly, the Transfer Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
