HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.9136 of 2017 Order:

This Writ Petition is filed challenging the action of the respondents in keeping the petitioner's Truck (Eicher-Canter) bearing registration No.KA-45-5192, at Tobacco Board premises from 04.02.2017. When the matter is taken up for consideration, it is represented by the learned Government Pleader that the seized vehicle was kept in the safe custody of the Officer on Special Duty (Vigilance Officer), Tobacco Board, Guntur and a report was filed by the Inspector of Police-Station House Officer, Nagarampalem Police Station before the Special Mobile Magistrate, Guntur, vide memo dated 17.03.2017 in respect of the vehicle. In view of submission of seizure report before the concerned Court, learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to avail the alternative remedy available under law.

In the circumstances, permission is accorded and, accordingly, the Writ Petition is dismissed as withdrawn granting liberty to the petitioner to avail the alternative remedy available to him under law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
