HE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5006 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A1 seeking bail in the event of his arrest in connection with Crime No.81/2022 on the file of Nampally Police Station, Hyderabad District, registered for the offences punishable under Sections 420, 376, 506 of Indian Penal Code and Section 3(2) (v) of SC/ST (POA) Act.

The case of the prosecution is that the defacto complainant filed complaint before the police stating that she is working as staff nurse in a hospital and during 2019 she came in touch with the petitioner herein. The petitioner used to continuously propose her, however, the said proposal was refused by the defacto complainant. Thereafter, it is alleged in the complaint that they had met in hotels over a period of time and ultimately when asked to marry he informed that he had no intention to marry her and that only for the purpose of having a physical relation, he had moved along with the defacto complainant. She also alleged that the family members of the petitioner who are A2 to A6 also insulted the defacto complainant.

The family members of the petitioner/A1 who are A2 to A6 filed Crl.P.No.4695 of 2022 and this Court by order dt.08-06-2022 directed the Investigating Officer not to arrest Accused Nos.2 to 6. 4.

In the present facts and circumstances, the allegation is of acquaintance over a period of two years and ultimately the petitioner refused to marry and in the said process, the defacto complainant aggrieved by the refusal has lodged complaint against this petitioner and also family members.

Learned Assistant Public Prosecutor submits that having knowledge about the defacto complainant belonging to the SC community, the petitioner went along with her and ultimately refused to marry her which amounts to cheating. 6.

In the said circumstances, to meet the ends of justice, the petitioner/A1 can be granted the relief of anticipatory bail on the following conditions.

1) The petitioner/A1 is directed to surrender before the Station House Officer, Nampally, Hyderabad District, on 04-07-2022. On such surrender, the said Station House Officer shall release the petitioner/A1 on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees

Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A1 shall appear before the said Station House Officer every day at 10.00 a.m. till 18.07.2022 for the purpose of investigation. Thereafter, the petitioner shall appear as and when required.

3) The petitioner/A1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 7.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
