THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10627 of 2008 ORDER:

This Writ Petition is filed challenging the action of the third respondent - Executive Officer, Sri Ranganadhaswami Devasthanam, Peravalli Village, Kurnool District, in issuing the auction notice for auctioning the leasehold rights in respect of the lands, details of which were mentioned therein, which includes the petitioner's lands admeasuring Acs.11.00 cents covered by Survey Nos.410, 126/4 situated at Peravalli Village, Maddikarra Mandal, Kurnool District, on 01.05.2008.

This Court granted interim stay on 07.05.2008 and further, made the said order absolute on 24.06.2008.

It may be noted that the impugned auction notice was issued for the purpose of auctioning the leasehold rights in respect of the lands mentioned therein for a period of three (3) years i.e., 2008-11 and the said period had elapsed. It may also be noted that in the light of the stay granted by this Court, no auction could be conducted. In the circumstances, the Writ Petition does not require any further consideration.

CKR, J W.P.No.10627 of 2008 Accordingly, this Writ Petition is closed. It is made clear that closure of the Writ Petition shall not be construed as expressing any opinion with respect to the rights of either the petitioner or the temple. At this stage, it is contended by the learned counsel for the petitioner that patta has been granted in favour of the petitioner in respect of the lands admeasuring Acs.11.00 cents covered by Survey Nos.410, 126/4 situated at Peravalli Village, Maddikarra Mandal, Kurnool District, whereas the learned Government Pleader as well as the learned Standing Counsel asserts that the subject lands are inam lands and it is the inam burdened with service. This is a matter required to be considered in separate proceedings.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
