This Writ Petition is filed for a Mandamus to declare the action of the respondents in acquiring various extents of lands belonging to the petitioners in Survey Nos.10, 10(P) and 27 of Yendada Village, Visakhapatnam District, for the purpose of road widening without initiating the proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30/2013) and without paying the compensation, as illegal and arbitrary. The petitioners sought for a consequential direction to the respondents not to acquire their lands without paying compensation.

After arguing the case, Mr.A.Prabhakar Rao, learned Counsel for the petitioners, requested for permission of the Court to withdraw the Writ Petition with liberty to his clients to seek appropriate amendment to Writ Petition No.23681 of 2014 for claiming the relief, which is claimed in this Writ Petition. The request of the learned Counsel for the petitioners is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioners in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.47584 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous.
