THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION Nos.19568 and 19608 of 2017 COMMON ORDER :
Heard learned counsel for the petitioners in the respective writ petitions and learned Government Pleader for Land Acquisition for respondents 1 to 3, before ordering notice to unofficial respondents and perused the prayer in the writ petitions with supporting affidavits and other material on record. The main grievance of the petitioners in the respective writ petitions is that despite they are entitled for apportionment of compensation for part of the land under acquisition, the respondents are not considering the same and they also submitted objections to the 3rd respondent-Land Acquisition Officer.
The submission of learned Government Pleader for Land Acquisition as per the written instructions is that a draft award was approved by the Collector and the respondent-authorities have not received any written representation from the petitioners. However, the endorsements made by the respondent-authorities, which are filed along with material papers filed in support of the writ petitions show that the petitioners submitted representations/ objections on 02.02.2017 and 11.05.2017 respectively.
Having regard to the above, the respondents shall consider the representations/ objections if any, submitted by the petitioners, within one week from today and pass appropriate orders to include their names if they are entitled for compensation, before passing final award.
Accordingly, the Writ Petitions are disposed of at the stage of admission. No costs.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
