THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.11135 OF 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) Learned Government Pleader for Services, on instructions, would submit that there are no vacancies in the zone. Dr.K.Lakshmi Narasimha, Learned Counsel for the petitioner, would however contend that two posts of SubRegistrars are available at the I.G's office, Hyderabad and one at Nellore (Chits).

The impugned order dated 01.04.2015 places the petitioner at Serial No.30, and the 4th respondent at Serial No.10. The validity of this order is under challenge before the Tribunal. As long as the said order remains in force, the petitioner's entitlement to be appointed as a Sub-Registrar can only be on the basis of his seniority being reckoned at Serial No.30. It is not even the petitioner's case that any person junior to him was appointed as a SubRegistrar. Dr.K.Lakshmi Narasimha, Learned Counsel for the petitioner, would submit that in-charge arrangements have been made in a few cases.

It would be wholly inappropriate for us to undertake the task of examining whether or not any person, junior to the petitioner, has been placed in-charge of any post of Sub-Regisrar as these are matters which are required to be examined by the Tribunal in the O.A. We see no reason to interfere with the interlocutory order passed by the Tribunal rejecting the petitioner's request to suspend the memo dated 23.12.2013 and the consequential proceedings dated 01.04.2015 pending disposal of the O.A. Suffice it to make clear that this order shall not preclude the respondents from making in-charge arrangements. The Writ Petition fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall also stand dismissed.
