Dr.N.Chnadrakaladhara Reddy, Hyd v. Rajeshwar Tiwari, I.A.S., Hyd And Another
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI CONTEMPT CASE No.1932 of 2017 ORDER: (per SK,J) This contempt case was instituted alleging wilful disobedience to the order dated 06.03.2017 passed by this Court in W.P.No.3997 of 2017. By the said order, this Court directed the authority concerned to abide by and implement the order dated 26.09.2014 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.8960 of 2012. By the order dated 26.09.2014 passed in O.A.No.8960 of 2012, the Tribunal directed the Principal, Gandhi Medical College, Secunderabad, to re-fix the pay of the petitioner-applicant in UGC Scales of the year 2006 in terms of the relevant G.O. within a time frame. Learned Government Pleader would state that this order has been duly complied with.
Memo dated 23.12.2017 issued by the Special Chief Secretary to Government, Health, Medical and Family Welfare (A1) Department, Government of Telangana, is placed on record in evidence of the fixation of the pay of the petitioner as directed by the Tribunal.
The contempt case is accordingly closed. No order as to costs. Sri M.Srikanth, learned counsel for the petitioner, would state that the petitioner's pension is yet to be re-fixed and paid. This aspect of the matter, in our considered opinion, does not fall within the scope of these contempt proceedings. In the event the petitioner has any grievance with regard to the re-fixation of his pension and disbursal thereof, it is open to him to seek independent redressal of such grievance in accordance with law.
