HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.54 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.64 of 2015 from the file of Family Court, East Godavari, Rajahmundry, and transfer to Family Court, Vijayawada.

2. Wife filed this application and according to her affidavit, her marriage with respondent was performed on 21.04.2007 as per Hindu rites and customs at Rajahmundry. She stated that due to differences they are living separately and respondent filed F.C.O.P.No.64 of 2015 before Family Court, Rajahmundry and she filed maintenance case at Vijayawada and the same was disposed of and now two cases are pending at Vijayawada one is a criminal case for the offence under Section 498-A IPC and the other case is D.V.C.No.172 of 2012. She stated that F.C.O.P.No.64 of 2015 pending before Family Court, Rajahmundry, is to be transferred to Family Court, Vijayawada, by taking her convenience into consideration.

3. Respondent in spite of service of notice neither appeared in person nor through any Advocate.

4. Considering the reasons stated in the affidavit and also taking the convenience of wife into consideration, F.C.O.P.No.64 of 2015 is withdrawn from Family Court, East Godavari, Rajahmundry, and transferred to Family Co u rt, Vijayawada, Krishna District, for disposal in

accordance with law.

5. Accordingly, transfer C.M.P. is ordered.

6. Miscellaneous petitions pending, if any, shall stand closed. No costs.
