THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE NO.2097 OF 2016 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The undertaking given to this Court was on behalf of the Chief Electoral Officer and the State Election Commission, and not by the Principal Secretary, Municipal Administration and Urban Development Department (MA & UD). Consequently, no action can be taken against the Principal Secretary, MA & UD, for violation of the undertaking given by the Chief Electoral Officer and the State Election Commission.
Sri Vedula Venkata Ramana, learned Senior Counsel, would submit that contempt proceedings would be instituted afresh, among others, against the Chief Electoral Officer and the State Election Commission.
As no undertaking was given to this Court by the Principal Secretary, MA & UD, we see no reason to proceed against the Principal Secretary, MA & UD, under the Contempt of Courts Act, 1971.
The Contempt Case is, accordingly, closed.
