HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6837 OF 2023 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No.4 seeking bail in the event of his arrest in connection with Crime No.146 of 2023 on the file of Shadnagar, Cyberabad Police Station, registered for the offences punishable under Sections 302, 201 R/w 34 of Indian Penal Code. 2.

The case of the prosecution is that Accused Nos.1 to 4 have taken deceased in a car and caused injuries, resulting in his death. The incident happened on 06.03.2023. On the basis of the complaint filed by the father of the deceased that he went to Amanagal and did not return. The case was investigated and during the course of investigation, it was found that the petitioner along with three others caused injuries and consequently death of the deceased.

Learned counsel for the petitioner would submit that Accused Nos.1 to 3 were already granted bail by the learned Sessions Court, L.B Nagar on 18.07.2023. The petitioner was

shown as accused only on the basis of alleged confession of Accused Nos.1 to 3.

As seen from the remand report of Accused Nos.1 to 3 the involvement of this petitioner is spoken by the Accused Nos.1 to 3. Apart from the said confession there is no other evidence, who has seen this petitioner along with Accused Nos.1 to 3 or the deceased on the date of alleged incident. For the said reasons, this petitioner can be granted relief of anticipatory bail. 5.

Accordingly, this Criminal Petition is allowed on the following terms and conditions:

(i) The petitioner/accused No.4 is directed to surrender before the Station House Officer, Shadnagar Police Station on 07.08.2023. On such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties to the like sum to the satisfaction of concerned Station House Officer. (ii) The petitioner/accused No.4 shall appear before the Station House Officer, Shadnagar Police Station on every Friday at 10.00 a.m., for a period of eight weeks.

(iii) The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. _________________ K.SURENDER, J 02.08.2023 mmr/dsv
