THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5021 OF 2022 ORDER:

This Criminal Petitions is filed under Sections 437 and 439 of the Criminal Procedure Code by the petitioner/A1 in Crime No.501/2022 on the file of Madhapur Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 370-A (2) of Indian Penal Code and Sections 3, 4 and 5 of Prevention of Immoral Traffic Act, 1956.

The case of the prosecution is that the Madhapur Police searched the premises of this petitioner on the suspicion that on the name of Vision Family Saloon & Spa, the petitioner and others were running prostitution. When raid was conducted on 24.05.2022, the victim LW2 was found in the premises and it was brought to the notice of the police that this petitioner/A1 and others A2, A3 and A4 were sending customers to the victim LW2 for having sexual intercourse. For the said reason, all the three accused were arrested and telephones and cash were seized. 3.

Learned Counsel for petitioner would submits that the petitioner is a household lady and admittedly there are no minors in the said spa; and that the question of alleged prostitution does not arise for the reason of the alleged victim having come down from West Bengal. 4.

Learned Assistant Public Prosecutor submits that there no other criminal antecedents against this petitioner.

In the said circumstances, the petitioner is directed to be released on bail subject to the following conditions:

i) The petitioner/A1 shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of the XII Additional Metropolitan Magistrate, Cyhberabad at Kukatpally. ii) The petitioner/A1 shall appear before the concerned Station House Officer on every Monday 10.30 a.m. and 01.00 p.m. for a period of three (3) months or until filing of charge sheet, whichever is earlier.

iii) The petitioner/A1, after releasing on bail, shall not indulge in any activity attracting penal consequences, failing which the prosecution is at liberty to file petition seeking cancellation of bail.

iv) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed. __________________ K.SURENDER, J 20.06.2022 tk
