Miss. Saddikulla Geethika v. Kaloji Narayana Rao University Of Health Sciences And 2 Others
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE KUNURU LAKSHMAN WRI T PETI TI ON NO.18976 OF 2019 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that the Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent for not considering the request of the petitioner as arbitrary, illegal, unjust, without jurisdiction, contrary and violation of Article 14 of the Constitution of India consequently direct the 1st respondent to receive and consider the application along with original certificate of the petitioner for verification and admission into MBBS and BDS - 2019-20 degree course under 15% non local quota in affiliated colleges of the 1st respondent in the interest of justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.' 2.
Perusal of the affidavit filed in support of the writ petition does not even demonstrate as to what category of seat the petitioner is aspiring for.
3.
As we are informed that the counselling for Category A seats has already concluded and it is not clear as to whether the petitioner is aspiring for such a seat, we have no option but to dismiss the writ petition for incurable vagueness in the pleadings. In the event the petitioner is aspiring for either a B-Category seat or a C-Category seat, it would be open to her to approach the University in the light of the general order passed by this Court in a batch of writ petitions on 29.08.2019. 4.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
