HON'BLE SMT. JUSTICE G.ANUPAMA CHAKRAVARTHY SECOND APPEAL NO.756 of 2013 JUDGMENT:

This Second Appeal is arising out of the judgment and decree dated 12.06.2012 in A.S.No.122 of 2010 on the file of II Additional District Judge, Warangal, in dismissing the appeal, confirming the judgment and decree dated 23.07.2010 passed in O.S.No.1174 of 2000 on the file II Additional Junior Civil Judge. Appellant is the plaintiff No.1 in the suit.

Today when the matter came up for hearing, learned Counsel for the appellant filed Memo stating that the sole appellant died on 09.01.2021 and he came to know the same through the family members of the deceased-appellant, and in proof of the same, death certificate of the appellant, is filed. However, till today, no steps were taken to bring the legal representatives of the sole appellant on record. Therefore, the second appeal gets abated.

Accordingly, the second appeal is dismissed as abated. No order as to costs.
