ORAL ORDER:

By interim order dated 14.10.2015 this Court directed the respondent bank to arrange for payment of minimum time scale of pay attached to the post of sub-staff to the petitioner.

In paragraph 6 of the counter affidavit filed, the deponent to the counter affidavit asserts that petitioner has been paid minimum of the time scale attached to the post of regular sub staff and in February, 2017 petitioner was paid Rs.13,601/- which amount is arrived at after adding dearness allowance. 3.

According to learned standing counsel for the respondent bank, the revised time scale of pay of subordinate staff is Rs.9560/- and after adding the dearness allowance from time to time, the amount is paid to the petitioner. 4.

Learned counsel for petitioner disputes the said claim on the premise that as per the settlement arrived at the minimum of the time scale for subordinate staff at entry level is Rs.9560/- and periodically the amount increases and therefore, for the present in terms of the periodical increase, petitioner is entitled to Rs.16580/-.

As seen from the order passed, direction was to pay minimum of time scale but not graded increase of the pay which is ordinarily applicable to the regular staff, therefore, it cannot be said that respondents willfully disobeyed the orders of this Court. Accordingly, the contempt case is closed. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE: 17.3.2017 TVK
