2015-10-29A Ramalingeswara Rao2 pages

THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.35162 and 35187 of 2015 COMMON ORDER:

Heard the learned counsel for petitioners and the learned Government Pleader for Civil Supplies for respondents.

2. These two Writ Petitions are filed by the fair price shop dealers of shop No.31 of Pathagunta Village and shop No.6 of TKM Puram Village, Vedurukuppam Mandal, Chittoor District respectively.

Their authorizations were canceled, challenging which, they preferred appeals to the third respondent. They also filed W.P.Nos.17852 and 17052 of 2015 respectively challenging the orders of cancellation of authorization. This Court was not inclined to entertain the said Writ Petitions against the orders of cancellation, but gave liberty to the petitioners to file appeals and the orders of cancellation of authorization were kept under suspension till the disposal of the appeals. Now the petitioners want to invoke the remedy of revision before the second respondent against the final orders passed by the third respondent, but seek indulgence of this Court to the extent of suspension of orders of cancellation of authorization of the petitioners during the pendency of revisions. 3.

In the circumstances, liberty is given to the petitioners to file revisions against the final orders passed by the third respondent dated 16.10.2016 within a period of two weeks from the date of receipt of a copy of this order. The second respondent is directed to dispose of the revisions as expeditiously as possible and, during the pendency of revisions, the orders of cancellation of authorization passed by the second respondent on 06.06.2015 shall remain suspended. If the petitioners fail to file revisions within the time specified above, the order of the third respondent dated 16.10.2015 shall come into operation.

4. Accordingly, the Writ Petitions are disposed of. No order as to

costs. Miscellaneous Petitions, if any, pending shall stand closed. _______________________________ A.RAMALINGESWARA RAO, J Date: 29.10.2015 TJMR
