THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.25 OF 2015 ORDER:

The order, violation of which is alleged in the present Contempt Case, is the order passed in WP.MP.No.19588 of 2013 in WP.No.16169 of 2013 dated 17.06.2013 whereby interim stay of dispossession was granted.

The allegations, in the Contempt Case, are that the second respondent had given an undertaking before the authorities that, till he succeeded in the civil dispute, he would not make any construction nor enter into the land; and despite giving such an undertaking, he got issued Form 1-B on the first respondent, who had then tried to interfere with the petitioner's possession.

While admitting that he had earlier issued Form 1-B, the Tahsildar submits that these proceedings were issued as he was unaware of the order passed by this Court; and after coming to know of the facts, the name of the second respondent was deleted, and the name of the petitioner was uploaded on the web-site with respect to the subject land. As the earlier error appears to have been committed in ignorance of the order passed by this Court, and as the first respondent has purged himself of contempt by correcting the revenue records, restoring the name of the petitioner, and deleting the name of the second respondent, I see no reason

to proceed against the respondents under the Contempt of Courts Act, 1971.

The Contempt Case is, accordingly, closed.

Miscellaneous applications, if any, pending shall stand closed.
