THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION Nos.39262 & 39320 OF 2015 COMMON ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

Aggrieved by the refusal order, dated 20.08.2015, passed by the Joint Sub-Registrar, Guntur District, the 3rd respondent, the petitioners are stated to have filed representations before the District Registrar, Guntur District, the 2nd respondent, seeking to invoke the appellate jurisdiction.

Learned counsel for the petitioners states that the said representations are to be treated as appeals which are numbered as Appeal Nos.2616 and 2615 of 2015 respectively in each of the Writ Petitions.

However, the appeals contemplated under the Registration Act, 1908, are required to be filed in an appropriate proforma and not by way of representations and the said representations cannot be treated as appeals. When the same is pointed out by this Court, learned counsel for the petitioners had taken time on 03.12.2015 and now reports that on 04.12.2015, statutory appeals have accordingly been filed by the petitioners, which are pending before the 2nd respondent and sought early disposal of the said appeals. Keeping in view the facts and circumstances of the case, if any such appeals are filed by the petitioners as mentioned on 04.12.2015 or thereafter, the 2nd respondent shall examine the same and after getting appropriate material from the 3rd respondent, dispose of the said appeals expeditiously, preferably

within two months from the date of receipt of a copy of this order. The Writ Petitions are accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
