Nos.590 AND 591 OF 2017 IN/AND FAMILY COURT APPEAL NO.101 OF 2006 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) This appeal by the wife under Section 19 of the Family Courts Act, 1984, read with Section 28 of the Hindu Marriage Act, 1955, arises out of the decree of divorce granted by the Judge, Family Court-cum-V Additional District Judge, Tirupati in F.C.O.P.No.97 of 2002 filed by the husband.

By order dated 21.08.2006, this Court granted interim suspension of the order and decree under appeal. While so, F.C.A.M.P.Nos.590 and 591 of 2017 were filed by the appellant - wife to allow the appeal in terms of the memorandum of compromise dated 12.10.2017 entered into by and between the parties. In terms of the said memorandum, the parties agreed to lead marital life peacefully and they no longer wish to pursue the present litigation. The terms and conditions setout therein also record that both parties agreed to withdraw their respective allegations each other in this litigation and also withdraw/compound S.C.No.207 of 2004 pending on the file of the learned Assistant Sessions Judge, Kadapa.

Both the parties are present in person before this Court and the respondent - husband produced his Government of Andhra Pradesh identity card, where he worked as a District Minorities

Welfare Officer. Both the parties expressed in open Court that they are agreeable to the terms and conditions of the memorandum of compromise as they are now living together.

In that view of the matter, the appeal is allowed setting aside the order and decree dated 02.08.2006 passed by the learned Judge, Family Court-cum-V Additional District Judge, Tirupati in F.C.O.P.No.97 of 2002. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
