It is the case of the petitioner that the 4th respondent is trying to obtain construction permission for the land over and above his land of Ac.0-27 gunats in Survey No.485 of Manchirevula Village, Gandipet Mandal, Ranga Reddy District; and therefore he made a representation dated 13.08.2019 to respondents 2 and 3 not to grant permission to respondent No.4, without taking into consideration his representation and objections.
Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development, and the learned Standing Counsel for the respondents 2 and 3.
Learned counsel for the petitioner submits that the petitioner has interest in the property over which the 4th respondent has made an application for building permission, and therefore seeks a direction to the respondent authorities to consider the objections of the petitioner.
Learned Standing Counsel, on instructions, submits that no application of the 4th respondent, seeking building permission, is pending before the authorities. In those circumstances, the writ petition is premature, as there is no system, akin to the sort of a Caveat system, with the authorities to issue prior notice to alleged interested parties in cases of building permission applications. In the present case, in the event of construction permission being granted, either in favour of 4th respondent or anyone claiming with respect to the subject land, it would be open to the petitioner to challenge the same, in accordance with law. Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any pending, shall also stand closed.
