Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an order or orders, direction or directions, Writ or Writs, more particularly one in the nature of Writ of Mandamus and declare the actions of the respondents in laying pipe line through petitioner's house situated in Plot No.14B, in Sy. No.
38 A of Dirisimarru Village, without any proceedings is illegal, arbitrary and violative of Article 14 & 21 of the Constitution of India and against the enjoyment certificate issued by the MRO, Bhimavaram vide ROC No.290/99/(D), dtd.06-10-2001 consequently direct the respondents not to lay the pipe line through the residential house belongs to petitioner. WPMP.NO: 3988 of 2015 Petition under Section 151 of C.P.C. Praying that in the circumstances stated in the affidavit filed in the W.P., the High Court may be pleased to direct the respondents not to lay pipe line through the petitioner's residential place depriving the peaceful possession and enjoyment of their residential house situated in Plot No.14B, in Sy.No.38 A of Dirisimarru Village, pending disposal of WP No.2983 of 2015 on the file of the High Court.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and order of the High Court dated 12-02-2015 & 20-02-2015 made herein and upon hearing the arguments of Sri K.L.N.
