THE HON'BLE SRI JUSTICE A.V.SESHA SAI CONTEMPT CASE NO.2272 OF 2014 IN WRIT PETITION No.624 OF 2014 O R D E R :

Heard Sri Ch.Satish Kumar, learned counsel for petitioner and learned Government Pleader for Revenue (Telangana) and perused the material available on record.

This contempt case is filed under Sections 10 to 12 of the Contempt of Courts Act complaining willful disobedience of the orders passed by this Court in W.P.No.624 of 2014, dated 09.01.2014.

By virtue of the said order, this Court directed the respondent herein to consider the representations submitted by the petitioner in accordance with law and pass appropriate orders within a period of two months from the date of receipt of a copy of the order. Responding to the notice issued by this Court, a counter affidavit is filed, enclosing a copy of the notice dated 07.01.2015 and proceedings dated 23.01.2015.

A perusal of the order dated 23.01.2015 issued by the respondent, vide R.C.No.A/52/2015 clearly shows that the respondent rejected the application of the petitioner for issuance of pattadar passbook. While referring to the same, it is submitted by the learned Government Pleader that the said order passed by the respondent on 23.01.2015 refusing to issue pattadar passbook in favour of the petitioner is appealable under Section 5(5) of the A.P. Rights and Pattadar Passbooks Act, 1971.

In view of the above reasons, contempt case is closed and the respondent stands discharged. However, it is open for the petitioner to assail the order passed by the respondent-Tahsildar, Charla Mandal, Khammam District vide R.C.ANo.A/52/2015, dated 23.01.2015 as per the provisions of the A.P. Rights and Pattadar Passbooks Act, 1971. No costs.

Pending miscellaneous petitions in this Writ Petition, if any, shall stand dismissed in consequence.
