THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.16901 of 2015 ORDER:
The petitioner is aggrieved by the inaction of the Sub-Registrar, Salur, Vizianagaram, in receiving, registering and releasing the document presented by him in relation to his house property in TS No.159/2, Salur Village and Municipality,
Vizianagaram District.
Similar inaction of the Registration Authorities in relation to some other land in this very same survey number fell for consideration before this Court in W.P.Nos.23634 of 2012 and 25611 of 2013. The order dated 03.10.2013 passed by this Court in W.P.No.25611 of 2013 is placed on record. Perusal thereof reflects that a part of the land in this survey number was sold in a Court auction prior to 1971 and therefore, the claim of the Government that the entire land in this survey number belonged to it was not accepted.
For reasons alike as were mentioned in the aforestated orders passed by this Court, this writ petition is disposed of directing the Sub-Registrar, Salur, to receive and process the document presented by the petitioner in respect of the subject land. In the event the said document is found to fulfil the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Sub-Registrar shall complete the registration formalities and release the document in accordance with the due procedure.
Pending Miscellaneous Petitions shall also stand closed in the light of this final order. No order as to costs.
